Terms of Service

DearestDog is a trade name of Westerlinden Beheer B.V., a private limited company registered in the Netherlands (Chamber of Commerce 24346680). Our registered address is Westbaan 142, 2841 MC Moordrecht. You can reach us at hello@dearestdog.org.

• A private space to document your dog's life through photos, notes, and memories
• A companion, powered by Anthropic's API (Claude), to support reflection and remembrance
• An adventure map to log places you visited together (Plus and Legacy plans)
• A grief companion for those who have lost their dog

We reserve the right to modify, suspend, or discontinue features at any time, but we will give reasonable notice when doing so affects content you have stored.

To use most features, you need to create an account. You are responsible for keeping your login credentials secure, all activity that occurs under your account, and ensuring the information you provide is accurate.

You must be at least 16 years old to create an account.

You own everything you upload or create on DearestDog. We do not claim any ownership over your content.

By using the Service, you grant Westerlinden Beheer B.V. (trading as DearestDog) a limited, non-exclusive license to store and display your content solely for the purpose of providing the Service to you. We do not use your content for advertising, marketing, model training, or any other commercial purpose.

You are responsible for ensuring you have the right to upload the content you submit.

• Your messages are sent to Anthropic's API solely to generate a response in that session
• We do not store your conversations on Anthropic's systems beyond what their API agreement requires
• We do not use your companion conversations to train models - ours or Anthropic's
• Conversations are stored in your private DearestDog account only, visible only to you

Your privacy matters deeply to us. The core commitment is simple: we do not share your personal data with anyone, for any reason, except where required by law.

• We do not sell your data
• We do not share your data with advertisers
• We do not share your data with third-party analytics platforms
• We do not share your data with partners or affiliated organisations

We use a small number of third-party services strictly to operate the platform: Vercel (hosting), Supabase (authentication, database and storage), Anthropic (companion conversations), Mollie (payments), and Mapbox (adventure map).

Features described as unlimited, such as conversations on paid plans, are intended for personal, individual use. Unlimited does not mean automated, bulk, commercial, or unrestricted use at any scale.

• Companion conversations are for personal reflection - not automated, bulk, or programmatic use
• Photo storage is for photos of your dogs - not general cloud storage or unrelated content
• Profiles are for the dogs in your personal care - not for operating a commercial kennel or rescue organisation

If we notice usage significantly outside these boundaries, we will reach out before taking any action. We have no interest in penalising genuine dog lovers for using DearestDog the way it was meant to be used.

A portion of DearestDog revenue goes to organisations that support rescue dogs. The specific recipient(s) will be announced on our website once selected. We will share the impact of this - in the form of dogs helped - but do not publish financial details.

Donations made directly through the Service are processed by Mollie. DearestDog does not retain a fee on donations.

DearestDog is a private, personal space. You may not use the Service to:

• Upload content that is illegal, harmful, or violates the rights of others
• Attempt to access other users' accounts or data
• Disrupt or damage the operation of the Service
• Use automated tools to scrape or extract content

We aim to keep the Service available and your data safe. We cannot guarantee uninterrupted access. In the unlikely event of a data breach that affects you, we will notify you as required by applicable law.

If you close your account, we will delete your personal data within a reasonable period. We do not make promises about permanence of storage - please keep your own copies of content that matters to you.

If your account exceeds the limits of your current plan, existing memories, notes, conversations, dog profiles, and photos remain accessible. New uploads, new dog profiles, or other additions may be restricted until your account is back within the applicable limits.

If an account remains above the limits of its current plan for more than 90 days without activity, photos above the limit may be compressed to reduce storage requirements. We will notify you before this happens. Memories, notes, and conversations are not removed as part of this process.

To the fullest extent permitted by Dutch and EU law, Westerlinden Beheer B.V. (trading as DearestDog) is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

Nothing in these terms affects your rights as a consumer under applicable law, including rights that cannot be waived or excluded.

These terms are governed by Dutch law. Disputes will be subject to the jurisdiction of the courts of the Netherlands, unless mandatory consumer protection law in your country of residence provides otherwise.

When we update these terms, we will update the effective date and notify you by email if the changes are material. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
